DEFINITIONS

  • “Information notices/disclaimers”: these terms and conditions;
  • “CONAI”: the National Packaging Consortium;
  • “website” or “site”: the homepage and the web pages contained therein, or any other collection of information and/or applications managed by CONAI and made available with access through devices such as PCs, laptops, mobile phones, handheld computers, digital cameras, television sets or other network devices for networks connected physically or wirelessly;
  • “content”: web pages, text documents, graphics, images and photographs, databases, software, and any other audiovisual material of any type and nature;
  • “services”: all functions, tools, applications, information or other services available through this website;
  • “visitor/user”: any person who accesses the website, with or without the permission of CONAI, or who uses it, regardless of whether they are a registered user of this website;
  • “third parties”: natural or legal persons or any other entity other than CONAI;
  • “EPR Organisation Member companies”: all companies registered with the CONAI system;
  • “framing”: the inclusion of a “called” (linked) page within the structure of a “calling” (linking) site;
  • “deep link”: a direct reference to a specific page of a site, without passing through the homepage of that site.

TERMS AND CONDITIONS OF USE OF THE WEBSITE

Anyone accessing or using this website in any manner accepts, without limitation, to be bound by these terms and conditions. If the user does not accept them or does not intend to be bound by them, they must not access the website, consult the content of the website’s pages, download or use material from this website.

CONAI reserves the right to update or amend these conditions at any time without any obligation to give prior notice. In the event of amendments to the conditions, access to the website implies the undertaking to comply with the conditions as amended and published on the website itself.

APPLICABLE LEGISLATION

All content published on or present on the website, including its selection and organisation as well as the layout and design of the website, is subject to the applicable legislation on the protection of personal data, to copyright law (Law 22 April 1941, No. 633, as amended by Legislative Decree No. 518 of 29 December 1992 on the legal protection of software, as subsequently amended and supplemented), and to other national and international legislation concerning the protection of intellectual and industrial property, including any amendments and additions to them.

This website is the exclusive property of CONAI, which has obtained the assignment of the internet domain name in accordance with the procedures and methods in force at the time of the request for assignment. It is further specified that:

  • the management of the website is the responsibility of CONAI, which is also the provider and the party responsible for the related content;
  • the rights in the Content belong to CONAI. Some web pages of this website may also contain material subject to the copyright of those who have made it available (e.g. EPR Organisation Member companies).

CONAI does not transfer any rights in any content of the website downloaded and used by the user.

CONTENT OF THE WEBSITE

The content of the website has been prepared in compliance with Italian law and European Union directives and is intended for national and international users.

For an organised presentation of the content of the website, reference should be made to the “Site map” section.

The selected model for the website one that combines public and private access: in some areas of the website, information (in the form of text, drawings, photographs) has been included which CONAI intends to share with the wider internet community; other areas are for private consultation, that is, accessible only to users with an authorised profile.

PURPOSE OF THE WEBSITE

CONAI has chosen the internet as a means of providing information, communicating and engaging with the public, in order to highlight its activities and to illustrate initiatives connected with achieving the overall targets for the recovery and recycling of packaging waste imposed by national legislation on the Consortium itself.

More specifically, in line with the institutional functions assigned to CONAI under current legislation, the Consortium considers it necessary or appropriate, for the achievement of its objectives, to promote public awareness of the relevant regulations governing packaging management, whilst ensuring that its members have full access to and can make use of the relevant legislation, forms and related instructions. It is further specified that:

CONAI is committed to disseminating up-to-date and accurate information as quickly as possible. For this reason, CONAI:

  • adopts appropriate procedures to ensure standards of accuracy, completeness, adequacy, updating and timeliness of the information contained on the website;
  • undertakes to eliminate any technical or typographical errors as quickly as possible;
  • reserves the right to make, at any time and without prior notice, changes, corrections and improvements to the aforementioned information;
  • CONAI assumes no responsibility of any kind with reference to the use of its website and its content. In particular, it cannot in any way be held liable for deficiencies in accuracy, completeness, adequacy or timeliness of the information contained on the website, nor for any damage or viruses that may affect the user’s computer equipment or any other property as a result of access or inability to access, use or navigation of the website, or downloading of news, documents, materials, data, text, images, graphics, video or audio from the website. CONAI also reserves the right to interrupt or suspend the website’s functionality at any time without incurring any liability;
  • although CONAI endeavours to ensure that the information on its website is accurate and up to date, it cannot guarantee that any regulatory references or legal texts available online accurately reflect the latest official version.

REGISTERED TRADEMARK

“CONAI” is a registered trademark exclusively owned by CONAI – Consorzio Nazionale Imballaggi and, therefore, it is prohibited to publish, copy or modify it without the prior authorisation of CONAI. Without prejudice to CONAI’s right to take action in accordance with the law to protect its rights, it may also adopt, without any prior notice, any corrective measures in the event that violations of the conditions of use of its trademark are detected.

CONAI cannot be held responsible for the content of documents on which its trademark is affixed and, therefore, does not provide any guarantee as to the currency, accuracy, completeness, quality or legality of the information contained therein.

Other product or company names used on this website may be registered trademarks of their respective owners.

TERMS OF USE FOR MATERIALS PUBLISHED ON THIS WEBSITE AND REPRODUCTION BY THIRD PARTIES

1.Permitted conduct

Access, as a registered user or as a non-registered visitor, to this website and its Content is permitted only for the purposes authorised by CONAI and indicated on this website.

The downloading, viewing, reproduction or printing of information from this website is permitted exclusively for personal use, to facilitate compliance with legal obligations or for informational purposes (in the latter case, provided that the source is cited when the information is viewed or otherwise used by the user), to the exclusion of any commercial purpose.

Copying and/or printing of materials contained on the CONAI website is permitted solely for personal and non-commercial use.

2.Prohibited conduct

Any use for commercial purposes or financial gain is always prohibited.

The following are in any case also prohibited:

With regard to this last point, CONAI draws the visitor’s attention to the following rules:

  • personal data originating from forums and newsgroups may not be used freely; knowledge of such data cannot be separated from the purpose for which it is made available.   • email addresses published on this website may not be used freely. The mere availability of an email address in a public space on the internet does not imply that it may be used freely for electronic mailing;

3.Prohibited conduct – Consequences

Without prejudice to any rights, powers or remedies of third parties, CONAI reserves the right to take action in accordance with the law to protect its rights.

Where violations of the conditions of use of the website are identified, CONAI reserves the right to take, without any prior notice, any corrective action, including denying the visitor/user access to the website and its services and removing any material posted on the website by that visitor/user, without assuming any liability in this regard, whether direct or indirect.

CONAI hereby undertakes to cooperate with the competent authorities including for the purpose of promptly identifying those responsible for the offences.

LINKS TO OTHER WEBSITES

The CONAI website may contain links to other websites of third parties. By clicking on these links, the user voluntarily leaves the CONAI website and is directed to web pages of sites on the network that are different from this CONAI website.
